Article 1 (Purpose)
The purpose of these Terms of Service (hereinafter the "Terms") is to set the rights, obligations and legal relationships between the Korea Information Certificate Authority (hereinafter the “KICA”) and customers under which the customers use the service provided by signOK.
Article 2 (Effect of the Terms)
① These Terms take effect when they are posted on the service screen or website.
② KICA may update these Terms to the extent permitted by applicable laws and regulations and post it as specified in Article 2-1 above. However, any important changes regarding the rights and obligations of the users are notified at least 7 days prior to such changes.
③ The users may terminate their membership if they do not accept any changes in the Terms. If they do not express such intention, it is deemed that they agree to the changes.
④ KICA is not responsible for any loss or damage caused to the users by a lack of understanding of the new Terms.
Article 3 (Service Charges & Refund)
① The types and rates of the service provided by KICA are posted on the website.
② Any changes in the policy related to service types and rates are posted on the website.
③ The service subscribers may request refund within 10 days from the date of payment if they have not used any of the service that requires payment.
Article 4 (Changes in Service)
① KICA may change the whole or part of the service if reasonably required for operational or technical reasons.
② KICA is not responsible for any loss or damage caused to the users if the service is temporarily unavailable in accordance with Article 4-1 above.
Article 5 (Suspension of Service)
① KICA may suspend its service temporarily for regular or occasional system maintenance, security enhancement and other operational reasons.
② KICA is not responsible for any loss or damage caused to users if the service is temporarily suspended in accordance with Article 5-1 above.
Article 6 (Use of Personal Information)
KICA uses personal information solely for the purposes of providing the services under the applicable laws and regulations.
Article 7 (Outsourcing Personal Information)
Although KICA processes and manage personal information on its own in principle, it may outsource the whole or part of the processing to third-party service providers if necessary under the applicable laws and regulations.
Article 8 (Privacy Protection of Users)
① KICA seeks technical and administrative measures to protect the users' personal information to the best of its abilities.
② KICA does not disclose or distribute users' personal information to third parties without their consent, unless required by law for investigation or requested by the Information and Communication Ethics Committee under applicable laws and procedures.
Article 9 (Refusal to and Restriction of Use)
① KICA may restrict or refuse to provide services if the user fails to meet their obligations or interferes with the service operation.
② KICA may suspend the user from using the service if the user uses someone else's identity to create an account. In this case, the user takes full responsibility for any loss or damage caused to KICA.
Article 10 (Assignment)
The users are not allowed to assign or transfer the rights to use the services or any titles granted under the user agreement.
Article 11 (Indemnity)
① KICA is liable for any loss or damage caused to its subscribers or users under the applicable laws and regulations.
② The users are liable for any loss or damage caused to KICA due to negligence or willful intent.
③ The liability under Article 11-2 above is exempt in the event of force majeure.
Article 12 (Limitation of Liability)
① KICA is not responsible for any interruption of service due to a force majeure event including natural disaster or the fault of users.
② KICA is not responsible for any changes or unavailability of service unless it is caused by willful intent or negligence of KICA.
③ The subscribers or users are responsible for any loss or damage at the end of the service contract such as closing account, and KICA is not responsible under any circumstances.
④ KICA is neither responsible for nor involved in contract process and performance between subscribers and users under any circumstances.
Article 13 (Confidentiality)
① KICA and the users should not disclose any confidential information or trade secrets of the other party obtained in the course of using the services to a third party without their prior written consent during and after the terms of service.
② However, the above obligation does not apply if such information has been already disclosed to public or the disclosure is required by laws or court order.
Article 14 (Governing Law & Jurisdiction)
① These Terms are interpreted and applied in accordance with the laws of Republic of Korea.
② Any dispute arising in relation to the service between the users and KICA is submitted to the court that has jurisdiction over the users or KICA's head office as the first court of jurisdiction.
(Date of Effect) These Terms are effective on April 16, 2018.
